Terms of Service

Thank you for your request

Effective Date: October 27, 2026

These Terms of Service (“Terms”) govern your access to and use of www.alicechosovich.com, including its pages, forms, booking and checkout features (collectively, the “Website”), and the personal styling, wardrobe consulting and related services offered by Vim & Vogue LLC dba Alice Chosovich (“Vim & Vogue,” “Alice Chosovich,” “Company,” “we,” “us,” or “our”).

By checking a box indicating your agreement, booking a service, submitting payment or otherwise expressly agreeing to these Terms, you agree to be legally bound by them. If you do not agree, do not book or purchase our services.

Our Privacy Policy describes how we collect, use and protect personal information.

IMPORTANT: SECTION 12 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE A DISPUTE DECIDED IN COURT BY A JUDGE OR JURY. YOU MAY OPT OUT WITHIN 30 DAYS AS DESCRIBED IN SECTION 12.

1. Website and Services

Vim & Vogue LLC dba Alice Chosovich provides personal styling, wardrobe consulting and related services. Information provided on the Website describes our general offerings but does not constitute a guarantee that a particular service, appointment, item or result will be available.

Submitting an inquiry, booking request or payment does not require us to accept an engagement. An engagement becomes effective when we accept the booking and, when applicable, both parties enter into a separate written client agreement.

These Terms apply only to the Website and services provided by Vim & Vogue LLC dba Alice Chosovich. They do not govern services provided by separately owned businesses, retailers or other third parties referenced or linked on the Website.

2. Separate Client Agreement

Personal styling engagements may be governed by a separate written client agreement. That agreement may address the specific scope of services, deliverables, fees, payment schedules, cancellations, rescheduling, refunds, client purchases, returns, alterations, travel, use of photographs and other engagement-specific matters.

If a separate client agreement conflicts with these Terms, the client agreement controls solely with respect to the services covered by that agreement. These Terms continue to govern the Website and all matters not addressed by the client agreement.

3. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding agreement to book or purchase our services.

If you book or purchase services on behalf of another person or an organization, you represent that you have authority to bind that person or organization to the applicable agreement.

4. Information You Provide

You agree to provide accurate, current and complete information when submitting an inquiry, booking a service or communicating with us. You are responsible for promptly informing us of material changes that may affect the services.

We may rely on information you provide, including information concerning your preferences, measurements, sizing, wardrobe, lifestyle, schedule and budget. We are not responsible for an unsatisfactory result caused by inaccurate, incomplete or outdated information supplied by you.

5. Acceptable Use of the Website

You may use the Website only for lawful, personal and legitimate business purposes.

You may not:

  • Use the Website in violation of applicable law;

  • Interfere with the operation, security or availability of the Website;

  • Attempt to gain unauthorized access to the Website or related systems;

  • Introduce viruses, malicious code or other harmful technology;

  • Scrape, copy, reproduce or extract Website content through automated means without written permission;

  • Impersonate another person or misrepresent your identity or affiliation;

  • Use the Website or its content to compete with us or develop a competing product or service; or

  • Infringe the intellectual property, privacy or other rights of Vim & Vogue or another person.

We may restrict or terminate access to the Website when reasonably necessary to protect the Website, our business, our clients or other users.

6. Intellectual Property

The Website and its contents, including text, photographs, graphics, branding, service descriptions, style guides, wardrobe plans, lookbooks, presentations, styling boards, frameworks and other materials created by us, are owned by or licensed to Vim & Vogue LLC dba Alice Chosovich and are protected by applicable intellectual-property laws.

Subject to these Terms and any applicable client agreement, we grant you a limited, revocable, nonexclusive, nontransferable license to use materials delivered to you for your own personal, noncommercial purposes.

Unless we give you prior written permission, you may not reproduce, publish, distribute, sell, license, modify, create derivative works from or commercially exploit our materials. You may not remove our branding, copyright notices or other proprietary markings.

Any ownership or usage rights specifically granted in a separate client agreement will control for the materials covered by that agreement.

7. Client Materials, Photographs and Feedback

You retain ownership of photographs, videos, documents and other materials you submit to us (“Client Materials”).

You grant us a limited license to access, store, reproduce and use Client Materials only as reasonably necessary to:

  • Respond to your inquiry;

  • Evaluate, provide and administer the requested services;

  • Create styling recommendations and deliverables;

  • Maintain appropriate business records; and

  • Fulfill the purposes described in our Privacy Policy.

You represent that you have the right to provide the Client Materials for these purposes and that doing so does not violate another person’s rights.

Submitting Client Materials for styling purposes does not give us permission to publish them or use them in advertising, social media, testimonials, case studies or our portfolio. We will obtain separate permission before using identifiable Client Materials for marketing or promotional purposes.

If you provide comments or feedback about our Website or services, we may use the underlying ideas to improve our business. We will not attribute a testimonial to you or publicly identify you without permission.

8. Third-Party Retailers, Products and Services

Our recommendations may include products, retailers, designers, tailors, booking providers, payment processors or other third-party services. Unless a separate client agreement expressly states otherwise:

  • Product purchases are transactions between you and the applicable retailer;

  • The retailer’s prices, shipping terms, return deadlines, refund policies and other terms apply;

  • You are responsible for reviewing product details and retailer policies before purchasing; and

  • We do not control third-party inventory, pricing, delivery, product quality, sizing, fit, alterations, authenticity, website availability or customer service.

Product availability and prices may change at any time. A recommendation does not constitute a warranty or endorsement of every aspect of a product or third-party business.

The Website may contain links to third-party websites or tools. We are not responsible for the content, security, availability or privacy practices of those third parties.

Some links may be affiliate links. If you purchase through an affiliate link, we may receive a commission at no additional cost to you. We will provide any disclosures required by applicable law.

Nothing in this section limits any responsibility we expressly accept in a client agreement or any consumer right that cannot legally be limited.

9. Fees, Bookings and Cancellations

Prices and service descriptions displayed on the Website are subject to change before a booking or written agreement is accepted.

Applicable fees, payment schedules, deposits, cancellations, rescheduling terms, refunds and other engagement-specific requirements will be stated in the booking process or separate client agreement.

We may correct typographical, pricing or service-description errors. If an error affects a booking that we cannot fulfill as represented, we will notify you and provide any refund required by the applicable agreement or law.

Once a separate client agreement becomes effective, we will modify, cancel or terminate the engagement only in accordance with that agreement and applicable law.

10. Styling Disclaimer

Styling is subjective. Recommendations reflect our professional judgment based on the information available at the time.

We do not guarantee:

  • That a recommended item will fit or remain available;

  • That an item will appear exactly as shown on a screen;

  • That you will like every recommendation;

  • That a retailer will accept a return or provide a refund;

  • That clothing or accessories will perform in a particular way; or

  • That styling services will produce a particular personal, professional, financial or social outcome.

Styling recommendations are not medical, psychological, financial or legal advice. Any references to comfort, confidence, body proportions, travel, workplace presentation or lifestyle are provided solely in the context of personal styling.

You remain responsible for your purchasing decisions, compliance with workplace or event requirements and final decisions about what you wear.

11. Disclaimer of Warranties and Limitation of Liability

To the fullest extent permitted by law, the Website is provided on an “as is” and “as available” basis. We do not warrant that the Website will always be uninterrupted, secure or error-free.

To the fullest extent permitted by law, Vim & Vogue LLC dba Alice Chosovich will not be liable for indirect, incidental, special, exemplary, consequential or punitive damages, including loss of profits, opportunities, data or goodwill, arising from or relating to the Website, these Terms or the services.

To the fullest extent permitted by law, our total aggregate liability for a claim relating to paid services will not exceed the fees you paid directly to us for the particular service giving rise to the claim. For a claim relating solely to use of the Website and not to paid services, our total aggregate liability will not exceed one hundred dollars ($100).

These limitations apply regardless of the legal theory asserted and only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence or any liability or consumer right that cannot lawfully be excluded or limited.

12. Dispute Resolution; Binding Individual Arbitration

Informal Resolution

Before initiating arbitration, the complaining party must send the other party a written notice describing:

  • The party’s name and contact information;

  • The facts and legal basis of the dispute; and

  • The specific relief requested.

Notices to Vim & Vogue must be emailed to alice.chosovich@vimandvogue.com with the subject line “Notice of Dispute.”

The parties will have 30 days after receipt of the notice to attempt to resolve the matter informally. Any applicable limitation period will be tolled during that 30-day period to the extent permitted by law.

Binding Individual Arbitration

Except for the matters identified under “Exceptions” below, any dispute, claim or controversy arising out of or relating to these Terms, the Website or our services that cannot be resolved informally will be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its then-current Consumer Arbitration Rules and Mediation Procedures.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

The arbitrator may award any remedy that would be available to an individual party in court, subject to applicable law and the limitations validly established by these Terms. Judgment on an arbitration award may be entered in any court with jurisdiction.

Waiver of Court and Jury Trial

YOU AND VIM & VOGUE LLC DBA ALICE CHOSOVICH UNDERSTAND THAT ARBITRATION REPLACES THE RIGHT TO HAVE A DISPUTE DECIDED IN COURT BY A JUDGE OR JURY. EACH PARTY KNOWINGLY WAIVES THE RIGHT TO A JURY TRIAL FOR CLAIMS SUBJECT TO ARBITRATION.

Fees and Location

Arbitration fees and arbitrator compensation will be allocated in accordance with the AAA Consumer Arbitration Rules and applicable law.

Any hearing will be conducted remotely or in the county where you reside, at your election, unless the parties agree otherwise or the arbitrator determines that another arrangement is required by applicable law.

Class Action Waiver

To the fullest extent permitted by law, you and Vim & Vogue LLC dba Alice Chosovich agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in a class, collective, consolidated or representative action.

Unless both parties agree otherwise, the arbitrator may not combine the claims of more than one person or preside over a class, collective, consolidated or representative proceeding.

Exceptions

Either party may:

  • Bring an eligible individual claim in small claims court;

  • Seek temporary or injunctive relief in court to protect intellectual-property rights or prevent unauthorized access to the Website; or

  • Report a matter to, or seek relief from, a government agency where applicable law permits.

Opt-Out Right

You may opt out of this arbitration agreement by emailing alice.chosovich@vimandvogue.com within 30 days after first agreeing to these Terms.

Your opt-out notice must include your full name, the email address used to book or purchase services and a clear statement that you are opting out of the arbitration provision in the Vim & Vogue LLC dba Alice Chosovich Terms of Service.

Opting out of arbitration will not affect the remaining provisions of these Terms or your ability to receive services.

Separate Client Agreement

If you enter into a separate written client agreement with us, a conflicting dispute-resolution provision in that agreement will control for disputes arising from the services covered by that agreement.

Severability of Arbitration Provisions

If the class action waiver is found unenforceable for a particular claim, that claim will proceed in court rather than arbitration. Any remaining claims that can lawfully be arbitrated will remain subject to arbitration.

If any other portion of this Section 12 is found unenforceable, it will be severed or modified to the minimum extent necessary, and the remainder will continue in effect.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. The Federal Arbitration Act governs Section 12.

For a matter not subject to arbitration, you and Vim & Vogue LLC dba Alice Chosovich consent to the exclusive jurisdiction of the state and federal courts located in King County, Washington, except where applicable law gives you the right to bring a claim elsewhere.

Nothing in these Terms deprives a consumer of a nonwaivable protection provided by the law of the consumer’s jurisdiction.

14. Changes to These Terms

We may revise these Terms periodically. The revised Terms will display a new effective date and will apply prospectively from that date.

When legally required or when a change is material, we will provide additional notice through the Website, by email or through another appropriate method.

Changes will not retroactively alter the terms governing a previously accepted client engagement unless the parties agree in writing or applicable law permits the change.

15. Website Availability and Events Beyond Our Control

We may modify, suspend or discontinue all or part of the Website at any time. We are not responsible for a delay or failure caused by circumstances beyond our reasonable control, including internet or platform outages, natural disasters, severe weather, labor disruptions, government actions, transportation interruptions or failures of third-party providers.

This section does not override cancellation, rescheduling or refund obligations in an applicable client agreement or under applicable law.

16. Miscellaneous

Entire Agreement

These Terms, together with any separate client agreement and additional terms expressly incorporated into either document, constitute the complete agreement between you and Vim & Vogue LLC dba Alice Chosovich concerning their respective subject matter.

Severability

Except as specifically stated in Section 12, if any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.

No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written permission. We may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization or transfer of our business, subject to applicable law.

No Third-Party Beneficiaries

These Terms do not create rights for any person or entity other than you and Vim & Vogue LLC dba Alice Chosovich.

Headings

Section headings are provided for convenience and do not affect interpretation.
